By placing an order with Webdesignbe.com, ch d’Alsemberg, 602A/14, 1180 Brussels (Belgium), you confirm that you are in agreement with and bound by the terms and conditions below.
Purchaser : The company or individual requesting the services of Webdesignbe.com.
Author: Webdesignbe.com’s Primary designer
Fees for web site development are usualy payable on a 50-40-10% basis. A 50% deposit is required to start design work, 40% – when the part of the work is completed, and the remainder due when whole project is done. Read your contract for more info.
Fees for logotype design are payable on a 50-50% basis. A 50% deposit is required to start design work, and the remainder due when whole project is done.
Fees for banner design are payable on a 100% upfront basis.
After the final payment Purchaser will receive all sources of the project (XHTML/CSS, *.psd files, fonts collection, Flash sources, Illustrator sources etc). When the site is delivered, it will be turned over to the Purchaser for a 30-day review and correction period. Any problems, bugs, or defectswill be fixed at no extra charge. Any changes made after the 30-day review period will be subject to additional charges.
All fees must be paid within the 5-day period. If the ten (10) day minimum is not met, an additional charge of 10% is due. If payment is not made within thirty (30) days of invoicing, simple interest will accrue weekly on the balance owed at a rate of 10% from the date the 10% penalty was levied. Author reserves the right to remove all web content from the Internet if payment is not made within thirty (30) days after delivery of the completion notification.
Cancellation of the project & Refund Policy
Cancellation of the web site development or web site template design at the request of the Purchaser must be made in writing. Cancellation of any web site development or web site template design project will result in a refund to the Purchaser of all fees paid, minus $175.00 and the amount already incurred in the development of the project by the date of cancellation, based on the amount of $95/hour. In the event more than fifty percent (50%) of the anticipated work is completed, additional payment will be due. If additional payment is due, this will be billed to the Purchaser within 10 days of notification to stop work. Final payment will be expected under the same terms as above. Cancellation refunds will be processed and mailed within 5 (five) business days of the cancellation date and will be made using the same method of payment as the original.
Cancellation of the banner design or logotype design at the request of the Purchaser must be made in writing. Author provide 100% refund, if Purchaser cancel his order within 24-hours of the order placement. 50% refund will be issued , if Purchaser cancel his order after 24-hours and he received his first design samples. In all other cases cancellation of banner design or logotype design project will result in a refund to the Purchaser of all fees paid, minus $100.00
Copyright Assignment Agreement
The Author represents and warrants that the graphic design (template, cartoon, drawing, design, or other rendering) delivered in final form is original work and that Author has full power to enter into this Agreement. The Author further represents and warrants that the Work does not knowingly infringe the copyright of property right of another and has not been previously sold, in whole or in part, with the following exceptions:
– Royalty free stock photography/images used.
– Text content for the template, provided by Purchaser.
– Other media, provided by Purchaser.
Author shall indemnify and hold by Purchaser , and his assigns, harmless against loss or expenses arising from breach of any such warranties.
For consideration received as a result of aforementioned work, the Author herebly grants all rights, title and interest in and to the Work, including copyright in all means of expression, including electronic format, to Purchaser.
The Author reserves the following rights:
1. The right to include samples of the work in Author’s personal portfolio.
2. The right to create derivative works that are substantially dissimilar to the Work and which do not include elements provided by Purchaser and custom illustrations, icons and buttons created for Purchaser.
Author will protect the privacy of any proprietary Purchaser information. No Purchaser lists are sold and no proprietary information is disclosed to any outside source. Any information provided to Author in confidence will remain as such unless the Purchaser grants written permission.
Designing process notes: The initial template ideas will be presented to the Purchaser by email within four working days of assigned start date. After receiving the Purchaser’s feedback , Author will proceed to the refinement stage or will produce additional template concepts. Up to 4 rough drafts of the main page will be provided. Once the draft has been approved by the Purchaser, Author will proceed to the design development phase of the project. Results of each revision phase will be presented to the Purchaser within 3 working days after the Purchaser’s feedback. Purchaser has to provide the feedback within 3 business days. If the one week minimum is not met, an additional charge of 1% every week is due.
The initial logotype concepts will be presented to the Purchaser by email within four working days of assigned start date. Purchaser will be notified by email and given access to a page where Author will post rough conceptual drafts of your logo. Purchaser will choose the ones he like best and Author will continue refining them according to Purchaser’s tastes. 4 revision included. Results of each revision phase will be presented to the Purchaser within 2 working days after the Purchaser’s feedback.
The initial banner concepts will be presented to the Purchaser by email within two-four working days of assigned start date. Purchaser will be notified by email and given access to a page where Author will post a banner. Author will continue refining them according to Purchaser’s tastes. 3 free revision included. Results of each revision phase will be presented to the Purchaser within 2 working days after the Purchaser’s feedback.
